Collaborative law is an alternative way of resolving any legal conflict but is particularly popular in the area of divorce. Litigation can be emotionally battering. Divorce mediation can be expensive, and the process can be weakened by the threat of going to court. Collaborative law offers another option.
Actively Counteracting the Threat of Litigation
The focus of collaborative law is on creating an atmosphere where a couple going through divorce can discuss and resolve the issues without the threat of going to court hanging over their heads.
Each spouse is represented by his or her own attorney, who brings to the table knowledge of legal rights and responsibilities, as well as experience with creative solutions. But all participants in the collaborative law process - including the lawyers - sign an agreement not to go to court.
In signing this agreement, the spouses do not give up their legal rights to fall back on the courts if necessary to protect their rights to a fair and timely divorce. However, if the divorce does go to court, the lawyers must withdraw, and the spouses must retain new litigation counsel. This eliminates otherwise inherent bias and provides for fair resolution.
This creates a situation where the attorneys have no incentive to push their clients into court. In addition, the participants agree that threats of litigation will not play a role in the negotiations.
Designed To Avoid the Pitfalls of Divorce
Collaborative law was developed in response to several problems with traditional divorce litigation. Many people have found litigation to be emotionally traumatic, especially for children who watch their parents go through an adversarial divorce. Litigation is also expensive, involving court fees and extensive trial preparation by attorneys.
Collaborative law not only takes the issues out of a litigation context but also removes the threat of litigation, which can lead to many of the same problems as litigation itself.
